Buying and selling goods in the electronic store "Made in Mažeikiai"

Rules

1. Concepts

1.1. Seller – a natural or legal person specified in the order of goods, whose goods are sold on the website www.visit.mazeikiai.lt in accordance with these Rules and who is responsible for the execution of the order submitted by the Buyer. The requisites of the seller with whom the purchase-sale agreement of the relevant goods is concluded in accordance with these Rules are specified in the Goods order.
1.2. visit.mazeikiai.lt – website located at the address www.visit.mazeikiai.lt, where the Sellers' goods are for sale and which is administered by the Republic of Lithuania VĮ "Registrų centras", a private legal entity registered in the Telšiai branch of the Register of Legal Entities, the Public Institution Mazeikiai Tourism and Business Information Center (hereinafter - the Center), legal entity code 267396950, registered office address Ventos st. 8A, Mazeikiai, correspondence address Ventos St. 8A, Mazeikiai. In these Rules, Visit.mazeikiai.lt is also understood as the Seller in relation to the goods it sells.
1.3. Buyer - 1) an able-bodied natural person, that is, a person who has reached the age of majority, whose capacity is not limited by court order; 2) a minor between fourteen and eighteen years of age who has the consent of his parents or guardians, except in cases where he is emancipated; 3) legal entity.
1.4. Parties - Buyer and Seller together.
1.5. Personal data - any information about an identified or identifiable natural person (data subject); an identifiable natural person is a person who can be directly or indirectly identified, in particular by an identifier such as a name, a personal identification number, location data and an Internet identifier, or by one or more characteristics of that natural person's physical, physiological, genetic, mental, economic, cultural or social identity. .
1.6. The rules are these "Made in Mažeikiai Rules for the purchase and sale of goods", which apply to every purchase made by the Buyer at "Made in Mažeikiai" and to every Purchase-Sale Agreement concluded between the Buyer and the Seller.
1.7. Account - the result of the Buyer's registration at "Pagaminta Mažeikiai" based on the Rules for using "Made in Mažeikiai", which creates a personal account of the Buyer protecting his personal data and order history.
1.8. Privacy policy - a document approved by the Center, which provides the basic rules for the collection, storage, processing and storage of Personal data, using the Center's privacy policy does not include the processing of Personal data when such data is processed by the Seller. The processing of personal data by the Seller is carried out in accordance with the procedure established by the Seller. Before purchasing the goods and concluding this contract with the Seller, the Buyer should carefully familiarize himself with the personal data processing policy applied by the Seller.
1.9. Agreement - the Buyer and the Seller enter into a purchase and sale agreement for the respective Goods, which is considered concluded from the moment of Order confirmation, i.e. the moment the order is submitted. The terms of each Agreement concluded between the Buyer and the Seller are deemed to be identical to the terms of these Rules and such Agreements are always executed by the parties in accordance with these Rules.
1.10. Order – Order of Goods, which contains the Goods that the Buyer wishes to purchase from the Seller, specified in the same order.

2. General provisions

2.1. The buyer approves the Rules after familiarizing himself with them and ticking the box next to the statement "I have familiarized myself with the rules for the purchase and sale of goods "Made in Mažeikiai" and I agree with them". The Rules approved in this way are a binding legal document for the Parties, which determine the rights and obligations of the Buyer and the Seller, the conditions for purchasing and paying for goods, the procedure for the delivery and return of goods, the parties' responsibilities and other conditions related to the purchase and sale of goods "Made in Mažeikiai".
2.2. By creating an account "Made in Mažeikiai", the buyer confirms the Rules during the first registration. After the Buyer approves the Rules during the first registration (account creation), the Rules apply to all Buyer's purchases made in "Made in Mažeikiai" and to all sales contracts concluded with Sellers until the updated Rules are published. After updating the Rules, they are applied according to the procedure discussed in this point from their publication at www.visit.mazeikiai.lt .

2.3. Only Buyers, as defined in Clause 1.3 of the Rules, have the right to buy "Made in Mazeikiai". By approving the Rules and having familiarized himself with the Privacy Policy (Clause 2.4 of the Rules) and the Rules of Use of "Made in Mažeikiai", the buyer confirms that he has the right to purchase goods from "Made in Mažeikiai".
2.4. If the necessity arises or if there are circumstances provided for in the legal acts of the Republic of Lithuania, "Pagaminta Mažeikiai" has the right to change, amend or supplement the Rules. Buyers will be informed about this when logging in to the Account or "Made in Mažeikiai" when purchasing goods from the selected Seller after the entry into force of the new version of the Rules.
2.5. The buyer must familiarize himself with the approved and publicly published Privacy Policy of "Pagaminta Mažeikiai". The Buyer's Personal Data will also be transferred to the Seller from whom the Buyer purchases the Goods and such Personal Data will be processed in accordance with the procedure specified by the Seller in the order, as well as in accordance with the security obligations assumed by the contract between "Made in Mažeikiai" and the Seller regarding the security of personal data.
2.6. If the Seller has the right or obligation to provide the Buyer with information or documents by e-mail, in all cases the Buyer is responsible for providing the Seller with a working e-mail address belonging to the Buyer.

3. Ordering goods, the moment of creation of legal relations of purchase and sale

3.1. The buyer can order goods "Made in Mažeikiai" by choosing one of the following methods:

3.1.1. by registering "Made in Mažeikiai" online (by entering your registration name and password);
3.1.2. without registering on the Internet "Made in Mazeikiai";
3.1.3. by telephone;
3.1.4. at the point of sale, in the premises of the Public Institution Mažeikiai Tourism and Business Information Center at Ventos St. 8A, Mažeikiai (hereinafter referred to as the Center).

3.2. When ordering goods in one of the ways specified in points 3.1.1 - 3.1.2 of the Rules, in the relevant information fields provided in the "Pagaminta Mažeikiai" system, the buyer must indicate his Personal data necessary for the proper fulfillment of the goods order, which are processed by "Pagaminta Mažeikiai" in accordance with the Privacy Policy.
3.3. Orders for goods submitted by phone or at the Center are processed in accordance with the Rules and are subject to the provisions of the Privacy Policy. By placing an order, the Buyer agrees to the Rules and their application.
3.4. When the Buyer, after choosing the product or service to be purchased and creating a basket of goods, completes all the steps of the order, the last of which is the selection and confirmation of the payment method, it is considered that a purchase-sale legal relationship has arisen between the Seller and the Buyer and a purchase-sale contract has been concluded. The Buyer is informed about the confirmation of the order by sending a message to the e-mail specified by the Buyer. The Seller sends the Buyer a link to the valid Rules together with the order confirmation to the e-mail address specified by the Buyer.
3.5. By approving the Rules, the Buyer agrees that the instructions for the goods ordered by him will be provided in Lithuanian no later than at the time of delivery of the goods to the e-mail address specified by the Buyer. All essential information about the product and its features are provided in the Seller's product description "Made in Mažeikiai".
3.6.Each Buyer's order is stored in "Made in Mažeikiai" and in the Seller's database in accordance with the procedure set forth in their privacy policy.

4. Buyer's rights

4.1. The buyer has the right to buy goods and order services "Made in Mažeikiai" according to the procedure established by these Rules.
4.2. The buyer has the right to refuse the order in accordance with the procedure established by these Rules.
4.3. The buyer has the right to cancel the Agreement in accordance with the procedure established by these Rules.
4.4. The buyer has the right to exchange or return the purchased goods in accordance with the procedure established by the Rules.
4.5. The buyer has other rights established in these Rules, the Privacy Policy, the rules of use of "Pagaminta Mažeikiai" and the legal acts of the Republic of Lithuania.

5. Obligations of the buyer

5.1. When using "Made in Mažeikiai", the buyer must fulfill his obligations, comply with these Rules, the Privacy Policy, the rules of use of "Made in Mažeikiai", other conditions clearly indicated by "Made in Mažeikiai", and not to violate the legal acts of the Republic of Lithuania.
5.2. The buyer must pay for the ordered goods or services and accept them in accordance with the procedure established by these Rules. After choosing to pick up the goods at the Store, the Buyer must pick them up at the Center within the terms specified in the Rules.

6. Rights of the seller

6.1. The Seller and "Pagaminta Mažeikiai" have the right to cancel the Buyer's order without prior notice, if the Buyer, having chosen the payment methods provided for in clauses 8.2.1 or 8.2.2 of the Rules, does not pay for the goods within 3 (three) working days.
6.2. When the Buyer chooses the payment method provided for in Clause 8.2.3 of the Rules, the Seller, through "Made in Mažeikiai", has the right to contact the Buyer with the details specified in the order if there are any uncertainties regarding the information provided in the order. In this case, the term of delivery of the goods starts counting from the day of contact with the Buyer. The Buyer's order may be canceled without prior notice if: i) if the Seller fails to contact the Buyer within 2 (two) business days after placing the order, or ii) if the Buyer does not provide the Seller with the requested information within the deadline specified by the Seller, or iii) if the Buyer does not give the Seller consent to check his personal data.
6.3. The Seller has the right, at his own discretion, without the separate consent of the Buyer, to divide the purchase of the goods he has chosen to purchase (the goods of a specific seller in the basket) into separate orders, unless the Buyer wishes to purchase the goods in the basket by submitting one joint order before confirming the orders. In case of such breakdown, the price of additional services for a specific order (e.g. delivery of goods, delivery, etc.) is accordingly broken down for individual orders and is calculated for each order separately, so it may differ from the price of the services specified in the description of the specific product. The seller has other rights enshrined in these Rules, the Privacy Policy, other "Pagaminta Mažeikiai" documents and legal acts of the Republic of Lithuania.

7. Obligations of the seller

7.1. The Seller undertakes to carry out the Buyer's orders in accordance with the procedure set out in these Rules and to communicate with the Buyer by means of the "Made in Mažeikiai" website and never to communicate with the Buyer through any other channels, except for the cases when it is directly provided for in these Rules or on the "Made in Mažeikiai" website. Hereby, the Buyer and the Seller clearly confirm that any communication regarding order fulfillment, which is not made on the "Pagaminta Mažeikiai" website (system), does not obligate the parties and is not binding on them.
7.2. The Seller undertakes to provide the Buyer with the information established in Article 6.228-7 of the Civil Code of the Republic of Lithuania in a clear and comprehensible way in the "Made in Mažeikiai" system.
7.3. The Seller and "Pagaminta Mažeikiaeus" undertake to respect the privacy of the Buyer, to process the Buyer's Personal Data only in accordance with the Rules, Privacy Policy, rules of use of "Pagaminta Mažeikiaeus" and the procedure established by the legislation of the Republic of Lithuania and the European Union.
7.4. "Pagaminta Mazeikiai" undertakes to inform the Buyer before the order is placed about the suspension or termination of "Pagaminta Mazeikiai" functions that are significant for the fulfillment of the order, as well as the changes specified in clauses 6.2 - 6.3 of the Rules. Providing information in the "Pagaminta Mažeikiai" Account or on the "Pagaminta Mažeikiai" e-commerce website is considered appropriate notification. When the Buyer's order has already been accepted for execution, the Buyer is informed about the suspension or termination of "Made in Mazeikiai" functions relevant to the fulfillment of this order using one of the contact details specified by the Buyer (by phone, SMS message or e-mail).
7.5. Under the conditions stipulated in the rules, the Seller undertakes to provide the goods ordered by the Buyer and to accept the goods returned by the Buyer.
7.6. In the event that the Seller is unable to deliver the ordered goods to the Buyer due to important circumstances, "Pagaminta Mažeikiai" may offer him a similar or analogous product sold by another Seller by notifying the Buyer of this through one of the contact details specified by the Buyer (by phone, SMS message or e-mail). If the Buyer does not agree that a specific Seller's product should be replaced by a similar or similar product sold by another Seller, the Seller, who cannot deliver the product chosen by the Buyer, undertakes to return the money paid by the Buyer to the Buyer within 14 (fourteen) working days, if prepayment was made, and in all cases to cancel the order.
7.7. In the event that, within 3 (three) working days from the submission of the offer, the Buyer has confirmed with one of the contacts specified on the "Pagaminta Mažeikiai" e-commerce website that he agrees that the product should be replaced with a product sold by another Seller, the original Seller undertakes to return to the Buyer the funds he paid for the product, which the original Seller cannot deliver, and to compensate for the price difference.

7.8. The Seller, not agreeing to the Buyer's requirements, must provide the Buyer with a detailed, motivated written answer no later than 14 (fourteen) calendar days from the date of receipt of the Buyer's application through "Made in Mažeikiai", unless the legal acts of the Republic of Lithuania and the European Union stipulate otherwise.
7.9. The Seller undertakes to fulfill other obligations imposed on the Seller in the Rules and legal acts of the Republic of Lithuania.

8. Product prices, payment procedure and terms

8.1. The prices of goods in "Made in Mazeikiai" are indicated in euros, including the amount of VAT applicable at the time according to the legislation and other taxes, if such were applicable.
8.2. The Buyer can pay for the ordered goods in one of the following ways (the choice may be limited, so the final list of payment methods applicable to the relevant order is indicated with the relevant order):

8.2.1. using electronic banking;
8.2.2. by bank transfer;
8.2.3. in cash during delivery/collection of goods;

8.3. When the Seller receives payment for the goods, the order for the goods is confirmed.

8.4. The Buyer, by approving the Rules, agrees that the documents for the purchase of goods - invoices, which are also the warranty documents applicable to the goods, can be submitted to him physically together with the goods or electronically to the e-mail address specified in the Buyer's registration form immediately after the order is fulfilled. The invoices indicate the details of the Seller, the selected goods, their quantity, the discounts granted, the final price of the goods, including all taxes, and other data required to be approved by legal acts regulating accounting.
8.5. Invoices for goods purchased by the Buyer can also be placed in the "Made in Mažeikiai" Account held by the Buyer. After the buyer submits the order, he will be able to see and print the order sheet - the prepayment invoice - at Pagaminta Mažeikiai.
8.6. After the Seller has confirmed the order, the price of the goods may change only in exceptional cases, when the price of the goods has changed due to a technical error in the information systems, the correction of obvious (inadvertent) errors or other objective and essential reasons beyond the control of the Seller (in the presence of evidence supporting these reasons). If in such a case the Buyer does not agree to purchase the product at a new price, the Buyer may cancel the order by informing the Seller about this through "Pagaminta Mažeikiaiue" within 2 (two) working days through the contacts specified on the "Pagaminta Mažeikiaiue" e-commerce website. After canceling the order in accordance with the procedure provided for in this point, the Seller undertakes to return to the Buyer all the amounts paid by him according to such canceled order.
8.7. An administration fee of €2.00 may be applied to the shopping cart, regardless of the total price of all goods of the relevant Seller. By approving the Rules, the Buyer agrees to the procedure for applying the administration fee specified in this point and undertakes to pay it to the Seller. When the Buyer is refunded the money for the goods in cases provided by the Rules, the administration fee is also refunded to him, if the Buyer had paid it.
8.8. If the Buyer chooses goods from several different Sellers, the Buyer's basket of goods can be divided into separate baskets of goods for each Seller and separate orders can be made based on such baskets. In case of such breakdown, the price of additional services for a specific order (e.g. delivery of goods, delivery, etc.) is broken down for individual orders accordingly, and therefore may differ from the price of the services indicated in the description of the specific product.

9. Delivery of goods

9.1. When ordering the goods, the Buyer can choose one of the methods of presenting the goods, named in the specific offer of the goods sold by the Seller.
9.2. If the Buyer chooses the home delivery service during the order:

9.2.1. The buyer undertakes to indicate the exact place of delivery of the goods.
9.2.2. The buyer undertakes to accept the goods himself. When accepting goods, it is necessary to present a valid personal identification document (identity card, passport or new model driver's license). If the Buyer does not accept the goods himself, even though the goods are delivered to the address specified by the Buyer, the Seller has the right to transfer the goods to another person at the address specified by the Buyer, and the Buyer has no right to make claims to the Seller regarding the delivery of the goods to the wrong person.
9.2.3. The goods are delivered by the Seller or his authorized representative.

9.3. If the Buyer chooses to pick up the goods at one of the branches of the Lithuanian Post Office during the order:

9.3.1. The buyer can pick up the goods at one of the branches of the Lithuanian Post Office by paying the specified parcel redemption fee. If the buyer does not pay the above fee, the goods will be returned to the seller.
9.3.2. The ordered goods must be collected no later than within 3 (three) working days after the courier informed the Buyer by e-mail or SMS message that the goods can be collected.
9.3.3. The goods can be collected not only by the recipient specified in the order, but also by another person specified at the time of placing the order. When picking up goods, it is necessary to have with you and present a valid personal identity document (identity card, passport or new model driver's license) to the employee of the Lithuanian Post Office.
9.3.4. The service of picking up goods at Lithuanian Post offices is not provided in the following cases:

9.3.4.1. If the total weight of the ordered goods is greater than 20 (twenty) kg.
9.3.4.2. If the general dimensions of the goods ordered from the Seller do not allow the provision of this service.

9.4. The buyer can pick up the goods free of charge at Center Ventos St. 8A, Mazeikiai. If the Buyer chooses the following method when placing an order:

9.4.1. The ordered goods must be collected no later than within 3 (three) working days after the Seller informed the Buyer by e-mail that the goods can be collected.
9.4.2. Goods can only be collected by the person who placed the order or the person indicated at the time of placing the order. When picking up the goods, it is necessary to have with you and present to the employee of "Pagaminta Mažeikiai" a valid identity document (identity card, passport or new model driver's license).

9.5. If the Buyer chooses the delivery of the Goods to the Omniva postal machine or to the self-service terminal of LP EXPRESS parcels when placing the order:

9.5.1. Goods weighing less than 30 kg can be picked up at Omniva postal machines or LP EXPRESS parcel self-service terminals. Goods heavier than 30 kg are not delivered to postal machines and parcel self-service terminals.
9.5.2. The shipment must be picked up from the Omniva post machine within 7 (seven) calendar days after the Seller informed the Buyer by e-mail that the product can be picked up. The shipment must be collected from the self-service terminal of LP EXPRESS parcels within 5 (five) calendar days after the courier informed the Buyer that the product can be collected.

9.6. The delivery terms specified in the Product description are preliminary. The Seller delivers the goods to the Buyer in accordance with the terms specified in the goods order confirmation. The terms of delivery of goods do not apply in cases where the necessary goods are not available in the Seller's warehouse, and the Buyer is informed about the shortage of the goods ordered by him. By approving these Rules, the Buyer agrees that in exceptional cases the delivery of goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In this case, the Seller undertakes to immediately contact the Buyer and coordinate the delivery terms and other conditions. If the Seller does not deliver the goods within the term specified in the order and the Parties do not agree on an additional term for the delivery of the goods, the Buyer may use the right established in Clause 11.1 of the Rules - to refuse the contract for the purchase and sale of goods or services.
9.7. The Seller is released from responsibility for the violation of the deadlines for the delivery of the goods, if the goods are not delivered to the Buyer or are delivered late due to the fault of third parties unrelated and/or independent of the Seller or due to circumstances beyond the control of the Buyer.

9.8. During the delivery of the goods to the Buyer, the Buyer must check the condition of the shipment and the product(s) together with the courier, and in the case of physical collection of the goods at the Center, with "Pagaminta Mažeikiai" or his authorized representative, and sign the shipment transfer - acceptance document. After the buyer signs the consignment transfer-acceptance document, it is considered that the goods have been handed over in a suitable condition, without damages, the basis of which cannot be attributed to a factory defect, and there are no inconsistencies in the product(s) assembly (such as can be determined during the external inspection of the goods). Noticing that the packaging of the goods submitted is damaged (crushed, wet or otherwise externally damaged), the item (s) is damaged and/or the item (s) is inappropriate, the Buyer must mark it in the transfer of the product and in the presence of the courier, /Act of discrepancies. If the Buyer does not perform these actions, the Seller is released from responsibility for damage to the goods, when the basis for the occurrence of such damage is not a factory defect, and for discrepancies in the product package only if these discrepancies can be determined during an external inspection of the goods.
9.9. The risk of accidental loss or damage of the goods passes to the Buyer from the moment the goods are handed over to the Buyer.
9.10. If, based on clauses 9.2 - 9.5 of the Rules, the Buyer does not collect the goods within the specified period or fails to deliver them to the Buyer and the Buyer has paid for the goods and their delivery, the representatives contact the Buyer regarding another time and/or method of delivery of the goods. If the Buyer still does not collect the goods or fails to deliver them, such goods are returned to the Seller, the order is cancelled, and the money paid for the goods is returned to the Buyer after deducting the bank fees charged to the Seller for bank transfers, the goods delivery fee, if applicable, and the administrative fee provided for in Clause 8.7 of these Rules, if applicable.
9.11. If, based on clauses 9.2 - 9.5 of the Rules, the Buyer does not pick up the goods within the specified period or fails to deliver them to the Buyer and the Buyer has not paid for the goods, such goods are returned to the Seller, and the order is cancelled.

10. Product quality guarantee and expiration date

10.1. The characteristics of each product sold by the Seller "Made in Mažeikiai" are indicated in the product description attached to each product.
10.2. The goods offered by the seller for purchase are of suitable quality. The product complies with the consumer purchase and sale contract if:

10.2.1. the product corresponds to the description provided by the Seller and has the same characteristics as the product that the Seller provided as an example or model when promoting that product "Made in Mažeikiai";
10.2.2. the product is suitable for what this type of product is normally used for;
10.2.3. the product complies with the quality indicators that are usually typical of products of the same type and which the Buyer can reasonably expect based on the nature of the product and the statements made publicly by the manufacturer, his representative or the seller of the product, including advertising and labeling of the product, regarding the specific characteristics of the product.

10.3. Neither the Seller nor "Made in Mažeikiai" is responsible for the fact that the size, shape, color or other parameters of the goods sold by the Seller "Made in Mažeikiai" may not correspond to the actual size, shape, color or other parameters of the goods due to the characteristics of the display used by the Buyer or other technical reasons beyond the control of the Seller. Product photos are for illustrative purposes only and are exemplary. The colors, inscriptions, parameters, dimensions, sizes, functions, and/or any other features of the original products may look different than in reality due to their visual characteristics, so please refer to the product features that are indicated in the product descriptions. The buyer is recommended to read the product description.
10.4. The seller provides a quality guarantee valid for a certain period of time for different types of goods, the specific term and other conditions of which are indicated in the descriptions of such goods or together with the goods' invoice, which corresponds to the guarantee sheet.
10.5. The quality guarantee provided by the seller does not limit or constrain the rights of consumers, which are established by legal acts after purchasing a product or service of inappropriate quality.
10.6. The seller does not provide warranty maintenance services for the goods (except for simple checks of the functioning of the goods, which do not require special knowledge):

10.6.1. if the center (s) providing warranty service is outside the Republic of Lithuania, the Seller organizes the shipment of the Goods to such center (s);
10.6.2. if the center (s) providing warranty service is located in the Republic of Lithuania, the Buyer is directed to such center (s).

10.7. The warranty does not apply to the information contained in the information media. Costs for data loss or recovery are not covered.
10.8. In cases where, based on legal acts, a certain expiration date is determined for specific goods, the Seller undertakes to sell such goods to the Buyer in such a way that he is given a real opportunity to use such goods until the end of the expiration date.

11. The right to refuse the purchase-sale contract, return and exchange of goods

11.1. The right to withdraw from the sales contract:

11.1.1. The Buyer has the right to withdraw from the contract of sale of goods without giving a reason within 14 (fourteen) days by notifying the Seller or "Pagaminta Mažeikiaioe", which informs the Seller about the Buyer's decision to withdraw from the contract. The Buyer cannot use this right after concluding one of the contracts listed in Article 6.22810, Part 2 of the Civil Code of the Republic of Lithuania.
11.1.2. The Buyer informs "Pagaminta Mažeikiai" about the cancellation of the sales contract in one of the following ways: by filling out a sample contract cancellation form or by submitting a clear statement, which states his decision to cancel the contract. The contract cancellation notice is sent by e-mail. by mail at mazeikiutvic@gmail.com. After receiving the Buyer's notification, Pagaminta Mažeikiaiose immediately sends a confirmation of receipt of the notification and informs the Seller.
11.1.3 The period of 14 (fourteen) days provided for by the right to withdraw from the sales contract is calculated as follows: a. when a purchase-sale agreement is concluded, - from the day the Buyer or the person designated by him, excluding the carrier, receives the ordered goods; b. if the Buyer has ordered more than one product from different Sellers in one order and the goods are delivered separately, - from the day on which the Buyer or the person designated by him, excluding the carrier, receives the product from the relevant Seller; c. if the goods are delivered in different lots or parts, - from the day on which the Buyer or the person designated by him, except for the carrier, receives the last lot or part; d. if a contract is concluded for regular delivery of goods within a specified period, - from the day on which the Buyer or the person indicated by him, excluding the carrier, receives the first goods.
11.1.4. If the Buyer has refused the purchase-sale contract before the goods have been delivered to him, the Buyer must inform about this through the contacts specified on the "Made in Mažeikiai" website. The buyer's refusal is formalized as a rejection of the order and the Seller is informed about it.
11.1.5. If the Buyer has refused the purchase-sale contract after the product has already been delivered or he has collected it, the provisions provided for in Clause 11.6 of the Rules shall apply.

11.2. An additional money-back guarantee is applied by the seller

11.2.1.After 14 (fourteen), but before 30 (thirty) days from the day of delivery or collection of the goods, the Buyer has the right to use the additional money-back guarantee provided by the Seller "Made in Mažeikiai" to the Buyer, if all returned goods are with authentic labels, protective bags and original packaging, the single-use packaging of the goods is not damaged, i.e. the goods have not lost their appearance as they were sold. A buyer who participates in separate loyalty programs that provide more favorable conditions for an additional money-back guarantee will be subject to the provisions of such loyalty programs. The seller has the right to provide an additional money-back guarantee period in the description of the specific product "Made in Mažeikiai". In all cases, the additional money-back guarantee (if it is applied by the Seller in relation to a specific product) will be implemented mutatis mutandis in accordance with Rules 11.2.2-11.2.7. clauses provisions.
11.2.2. The Buyer must notify about the intention to use this guarantee (if applicable) within the term of such guarantee set by the Seller, calculated from the day of handing over the goods to the Buyer. The message is sent by e-mail. by mail at mazeikiutvic@gmail.com, the returned goods must be indicated in the message.
11.2.3. If notice is given within 14 (fourteen) calendar days from the day of handing over the goods to the Buyer, the provisions of Clause 11.1 of the Rules shall apply.

11.2.4. If notification is made after a period of 14 (fourteen) calendar days, but no later than within the validity period of the additional money-back guarantee set by the Seller from the day of handing over the goods to the Buyer (if the Seller applies an additional money-back guarantee), the Buyer bears all costs and risks related to the return of the goods. In all cases, the product must be returned to the Seller "Pagaminta Mažeikiai" before the expiration of such warranty period, calculated from the day of delivery or collection of the product.
11.2.5. The Buyer has the right to return the goods by sending them to the addresses indicated on the "Pagaminta Mažeikiai" e-commerce website or by bringing them to the Center or by handing over the Goods directly to the Seller.
11.2.6. The additional money-back guarantee applied by the seller cannot be used if the following goods are ordered:

11.2.6.1. "Made in Mazeikiai" gift vouchers;
11.2.6.2. packaged goods that have been unpacked after delivery and are unsuitable for return due to health protection or hygiene reasons;
11.2.6.3. baby clothes;
11.2.6.4. toys, baby toys, baby care products;
11.2.6.5. goods that were manufactured according to the Buyer's individual order or are obviously adapted to him, or which, due to their nature, cannot be returned to the Buyer due to the loss (loss) of their commercial properties, are perishable or expire;
11.2.6.6.N-18 assortment goods;
11.2.6.7. Footwear;
11.2.6.8.Clothes.

11.2.7. The procedure for returning goods and money is provided for in Clause 11.6 of the Rules.

11.3. Rules for exchanging and returning goods of suitable quality

11.3.1. The buyer has the right within 14 (fourteen) days from the day of handing over the goods to replace the purchased goods with similar goods of different dimensions, shape, color, model or completeness. If a price difference occurs when exchanging goods, the Buyer must settle with the Seller according to the recalculated prices. The buyer's notification of the desire to exercise the right provided for in this clause of the Rules with the specified returned goods is sent by e-mail. by mail at mazeikiutvic@gmail.com.
11.3.2. If the Buyer does not like the shape, size, color, model or completeness of the purchased goods, the goods are exchanged and returned in accordance with the Government of the Republic of Lithuania 2014. July 22 by resolution no. 738 of the approved "Rules of Retail Trade". Within the term provided for in Clause 11.3.1 of the Rules, the Buyer has the right to exchange and return all goods that are not included in this list:

11.3.2.1. tobacco and tobacco products;
11.3.2.2. perfumery, cosmetics and toilet preparations;
11.3.2.3. photography and cinematography goods;
11.3.2.4. printed books, reproductions and other articles of the printing industry;
11.3.2.5. fabrics;
11.3.2.6.knitted men's, boys', women's or girls' underwear;
11.3.2.7. baby clothes;
11.3.2.8. pantyhose, stockings, socks and other similar articles;
11.3.2.9.sewn men's, boys', women's or girls' undershirts, nightgowns, pajamas and similar articles;
11.3.2.10.bras, girdles, corsets and similar articles;
11.3.2.11. watches;
11.3.2.12. musical instruments;
11.3.2.13.furniture, bedding, lamps;
11.3.2.14. toys, games, except sports and fishing equipment;
11.3.2.15. works of art, collectibles and antiques;
11.3.2.16.weighed and measured goods that were specially prepared, cut, cut and similar at the request of the user.

11.3.3. After receiving the goods, the Seller undertakes to replace them with the same goods only in the shape, size, color, model or completeness specified by the Buyer. If the Seller does not have a product suitable for replacement, he returns the money paid for the product to the Buyer. The money is returned to the Buyer within 14 (fourteen) calendar days after the Seller received the Buyer's notification of the desire to exercise this right, and if the Buyer's Product is not returned to the Seller, the term provided for in this point is calculated from the day the Product is returned to the Seller.
11.3.4. By approving these Rules, the Buyer agrees that the money will be returned to the Buyer's bank account, except for cases where the Buyer and the Seller agree otherwise.
11.3.5. The procedure for returning goods and money is provided for in Clause 11.6 of the Rules.

11.4. Rules for exchanging and returning goods of inappropriate quality

11.4.1. Defects in the sold goods are eliminated, low-quality goods are exchanged, returned in accordance with the procedure laid down in the Rules and taking into account the requirements of the legal acts of the Republic of Lithuania.

11.4.2. If the Buyer purchased goods of inappropriate quality and noted this in the document of transfer - acceptance of the goods (if not noted, the provisions of Clause 11.3 of the Rules apply) or the inappropriate quality of the goods is manifested by a manufacturing defect that was present at the time of purchase of the goods, or non-compliance with the specifications specified by the manufacturer, the Buyer may return the goods and, at his option, may demand:

11.4.2.1. for the Seller to remove the defects of the goods free of charge within a reasonable period of time, if the defects can be removed;
11.4.2.2. to reduce the purchase price accordingly;
11.4.2.3. for the product to be replaced with an analogous product of suitable quality, except in cases where the defects are minor or they arose due to the Buyer's fault;
11.4.2.4. to return the paid price and refuse the purchase-sale agreement, when the sale of goods of inappropriate quality is a fundamental violation of the order.

11.4.3. The buyer can choose only one of the methods of protection of rights provided for in point 11.4.2 of the Rules. The Buyer must declare his choice when returning the product to the Seller. If, after the Buyer chooses the method provided for in point 11.4.2, the Seller does not have the opportunity to implement it, the Seller offers an alternative method provided for in point 11.4.2. The buyer does not have the right to change the chosen remedy. The buyer does not have the right to terminate the sales contract if the defect in the product is minor.
11.4.4. In order for the buyer to return the goods, it is necessary to comply with the following conditions:

11.4.4.1. notify the Seller about this via the contact specified in the invoice or "Made in Mažeikiai" e-mail. by mail at mazeikiutvic@gmail.com, the returned goods must be specified in the message;
11.4.4.2. submit the document of purchase of the goods, the document confirming the guarantee (if it was issued);
11.4.4.3. submit a free form request and submit it to the Seller or "Gamaminta Mažeikiai"

11.4.5. The Buyer may exercise the right to return goods of inadequate quality within the term of its quality guarantee set in the document of purchase of the goods, which is indicated by the Seller from whom the Buyer purchased the goods.
11.4.6. The Buyer must pay for the costs of delivery of the goods and the costs of returning the goods, and the Seller, convinced that the goods were returned due to inadequate quality, must return to the Buyer the costs of delivery and return incurred by him, except for the exceptions provided for in the Rules. Clause 11.6 of the Rules applies to the return of goods.
11.4.7. The money is returned to the Buyer within 14 (fourteen) calendar days after the Seller received the Buyer's notification about the product of inappropriate quality, and if the product is not returned by the Buyer to the Seller, the term provided for in this point is calculated from the day the Product is returned to the Seller. By approving these Rules, the Buyer agrees that the money will be returned to the Buyer's bank account, unless the Buyer and the Seller agree otherwise.
11.4.8. Money will not be refunded for those goods that have been damaged intentionally or due to negligence (affected by chemicals, water, open fire, high temperature, sharp objects, etc.), or if the rules of use or storage of the goods have been violated, or the goods have been used improperly or not according to their intended purpose.
11.4.9. Separate rules for the return of goods of unsuitable quality by the Seller may be provided in the warranty documents provided with them. Such return rules applied by the Seller shall apply to the extent that they do not conflict with these Rules. In the event of any inconsistency between these Rules and the applicable rules of the relevant Seller, these Rules shall prevail.

11.5. Exchange and return of goods after delivery of the wrong goods

11.5.1. If the wrong goods were delivered to the Buyer, the Buyer must immediately, but no later than within 7 (seven) working days, inform about this at "Made in Mažeikiai" e-mail. by mail at mazeikiutvic@gmail.com or by calling the phone number +370 443 67177. Upon receiving information about the wrong goods delivered, "Made in Mazeikiai" informs the Seller about this, who undertakes to pick up such goods and replace them with suitable goods at his own expense. In the event that the Seller does not have the ordered goods, he returns the money paid for the item(s) to the Buyer. The money is returned to the Buyer within 14 (fourteen) calendar days after the Seller has received the Buyer's notice of withdrawal from the contract, and if the Buyer's Product is not returned to the Seller, the term provided for in this point is calculated from the day the Product is returned to the Seller.
11.5.2. The procedure for returning goods and money is provided for in Clause 11.6 of the Rules.

11.6. Procedure for returning goods and money

11.6.1. Regarding the return of goods purchased from Sellers, the Buyer has the right to apply directly to the specific Seller from whom the goods were purchased or to "Made in Mažeikiai".
11.6.2. The Buyer can exercise the right to return the goods only if the deadline for returning the goods has not been missed. When returning goods, Rule 11.1. -11.3. in the cases specified in clauses, additional requirements apply: the product has not been damaged or has not substantially changed its appearance, nor has it been used - all returned products must be with authentic labels, protective bags and original packaging.
11.6.3. All gifts that were presented together with the purchased product must be returned at the same time, except for cases when the purchased product is returned due to its quality defects, and the gifts presented together with it due to their nature were consumed during the period from the purchase of the product to the day when the defects of this product became apparent or the period of usability of such gifts has expired.
11.6.4. When returning the goods, the Buyer must indicate the sender's address and properly pack the goods so that they are not damaged during shipping. The seller from whom the Buyer purchased the goods has the right not to refund money for goods that are returned with defects. The Seller is not responsible for parcels that were sent by the Buyer in improper packaging, with an incorrect address, as well as if the parcels were lost or damaged during return to the Seller.
11.6.5. If the Buyer has purchased a set of goods on Pigu.lt, he must return the entire set of goods to the Seller, that is, the Buyer can exercise the rights provided for the return of goods only in relation to all the goods in the set. In the event that at least one of the goods in the set does not meet the requirements stipulated in point 11.6.2 of the Rules, the Seller has the right to refuse to accept the returned whole set of goods.
11.6.6. After exercising the rights provided for in clauses 11.1-11.5 of the Rules, the buyer must fulfill the requirements for the return of the goods provided for in the Rules and follow the procedure provided for in them.
11.6.7. The Buyer can return the Goods by delivering them to the Center at the address Ventos str. 8A, Mažeikiai, by courier or directly to the Seller. The goods must be returned to the Seller at the address specified in the invoice provided by the Seller to the Buyer or through a courier, who in turn delivers the returned goods to the Seller. The procedure and conditions for the delivery of heavy goods (to assess the quality of the goods, change, repair or return them) to the Seller shall be agreed separately by the Buyer and the Seller through "Pagaminta Mažeikiai" by phone or e-mail. by mail to mazeikiutvic@gmail.com or the Buyer delivers them directly to the Seller.
11.6.8. If the Buyer has used the rights established in clauses 11.1, 11.3-11.5 of the Rules, the money shall be returned to him within 14 (fourteen) calendar days after the Buyer's notification was delivered to the Seller, and if the goods are not returned by the Buyer to the Seller, the term provided for in this clause is calculated from the day the goods are returned to the Seller. If the Buyer has used the additional money-back guarantee, he is subject to a refund period of 30 (thirty) calendar days, calculated from the day the goods are returned to the Seller.
11.6.9. By approving these Rules, the Buyer agrees that the money will be returned to the Buyer's bank account, except in cases where the Buyer and the Seller agree otherwise.
11.6.10. After using the rights established in clauses 11.1.-11.3 of the Rules, the Buyer shall be refunded: the price of the product, the administrative fee, if it was applied. Shipping costs are not refundable. After using the rights enshrined in clauses 11.4-11.5 of the Rules, the following shall be returned to the Buyer: the price of the goods, the administrative fee, if it was applied, the costs of delivering the goods, the costs of returning the Goods are not compensated.
11.6.11. If the Buyer has chosen another than the cheapest method of delivery of the goods offered by the Seller, which is published, the costs of the other method of delivery of the goods chosen by the Buyer that exceed the costs of this method are non-refundable.
11.6.12. The Seller has the right not to return the sums paid to the user until the goods have been handed over to "Pagaminta Mažeikiai" and have not been checked by the Seller for compliance with Clause 11.6.2 of the Rules.

12. Liability

12.1. The buyer is responsible for illegal actions performed using "Made in Mazeikiai".
12.2. The registered Buyer is responsible for storing and/or transferring his login data to third parties. If the services provided by "Pagaminta Mažeikiai" are used by a third person who has connected to "Pagaminta Mažeikiai" using the Buyer's login data, the Seller considers this person to be the Buyer.
12.3. The Seller is released from any responsibility in cases where the losses arise because the Buyer, disregarding the Seller's recommendations and his obligations, did not familiarize himself with these Rules, the Privacy Policy, the rules of use of www.visit.mazeikiai.lt even though he was given such an opportunity.
12.4. If "Pagaminta Mažeikiai" provides links to websites of other third parties, then "Pagaminta Mažeikiai" does not guarantee that the information that can be viewed by clicking on these links is correct, complete or accurate. Third parties are responsible for the content, correctness, completeness and accuracy of information provided by third parties. "Made in Mažeikiai" is not obliged to check the transmitted or stored external information or to identify illegal actions.
12.5. "Made in Mažeikiai" is not responsible for the proper performance of mutual obligations between the Buyer and the Seller whose goods or services the Buyer orders using "Made in Mažeikiai".

13. "Made in Mazeikiai" marketing tools

13.1. The seller may, at his discretion, initiate various promotions or games at "Pagaminta Mažeikiai".
13.2 "Made in Mažeikiai" has the right unilaterally, without a separate warning, to change the conditions of promotions or games, as well as to cancel them.

14. Exchange of information

14.1. All communication related to the purchase of goods using "Pagaminta Mažeikiaeus", regardless of the Seller of the goods, is carried out through "Pagaminta Mažeikiaeus", the contacts specified on the "Pagaminta Mažeikiaeus" e-commerce website. In the event that the Buyer and the Seller carry out communication related to the goods in other ways than through both.
